Military Pension is governed by the USFRSPA (Uniform Services Former Spouses Protection Act) and is designed to allocate property. The Act is an alternative mechanism for distribution. One example is if parties were married for ten (10) years and active military for ten (10) years, certain rules of the Act apply. If they were married less than that time, it requires an alternative means of payments. Once a military spouse is eligible for retirement, an ex-spouse may also be eligible for payments.
