In New Mexico, both parents have an obligation to provide support to their children. When calculating child support, income shares of both parents are combined and a guideline is applied, and is prorated between the parties based on their percentage of income.
Child Support is modifiable through a change of circumstance. New Mexico requires a substantial change in circumstances, and requires an annual exchange of income and the application of the guidelines to show there will be an increase or decrease. If there was a substantial change in income, the question of whether the change was voluntary or involuntary will be scrutinized by the court and by very careful attorneys like myself.
